Forum Paper Title: Representation of interests,
participatory democracy and the lawmaking in the European union: which role and
which rules for the social partners?
Description of Forum Paper:
The paper provides for an analysis of the lawmaking procedure in
social policy, enshrined in art.138 and art.139 of the EC Treaty, which
introduced an institutionalized model of participation. After having examined
the implications of the procedure in terms of normative models of
representation and democratic sources of legitimacy and accountability, some
fundamental changes are advocated in order to ensure that the aim of conferring
more democratic legitimacy to the lawmaking process is fully
accomplished.
